Ils permettent aux employeurs d&rsquo;identifier les postes, m\u00e9tiers et situations expos\u00e9s aux six facteurs de risques du\u00a0<strong>compte professionnel de pr\u00e9vention (C2P)<\/strong>\u00a0\u2014 bruit, travail de nuit, travail en \u00e9quipes successives alternantes, travail r\u00e9p\u00e9titif, temp\u00e9ratures extr\u00eames et activit\u00e9s en milieu hyperbare \u2014 avec la garantie d&rsquo;une pr\u00e9somption de bonne foi en cas de contr\u00f4le.<\/p><p>Mais un fait majeur bouleverse aujourd&rsquo;hui l&rsquo;\u00e9cosyst\u00e8me : la quasi-totalit\u00e9 des r\u00e9f\u00e9rentiels homologu\u00e9s entre 2016 et 2018 ont atteint leur date d&rsquo;expiration. Et le d\u00e9cret n\u00b0 2025-277 du 25 mars 2025 a pos\u00e9 de nouvelles r\u00e8gles du jeu. Si votre branche n&rsquo;a pas encore engag\u00e9 la d\u00e9marche d&rsquo;actualisation, le compte \u00e0 rebours est lanc\u00e9.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2276d10 elementor-widget elementor-widget-heading\" data-id=\"2276d10\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"Titre1\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Un cadre r\u00e9glementaire renforc\u00e9 depuis mars 2025<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e38a92 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"9e38a92\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Le d\u00e9cret du 25 mars 2025, entr\u00e9 en vigueur le 28 mars, clarifie et durcit les modalit\u00e9s d&rsquo;homologation des\u00a0<strong>r\u00e9f\u00e9rentiels p\u00e9nibilit\u00e9<\/strong>\u00a0de branche. Trois changements m\u00e9ritent une attention particuli\u00e8re :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-eafde7e e-con-full e-flex e-con e-child\" data-id=\"eafde7e\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2bc6be1 elementor-widget elementor-widget-heading\" data-id=\"2bc6be1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">D\u00e9cret n\u00b0 2025-277 du 25 mars 2025 \u2014 Points cl\u00e9s<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-59337cc elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"59337cc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li><strong>La dur\u00e9e d&rsquo;homologation est d\u00e9sormais fix\u00e9e \u00e0 cinq ans<\/strong>\u00a0par arr\u00eat\u00e9 conjoint des ministres charg\u00e9s du travail et des affaires sociales.<\/li><li><strong>L&rsquo;obligation d&rsquo;anticiper la r\u00e9\u00e9valuation<\/strong>\u00a0: l&rsquo;organisation professionnelle repr\u00e9sentative au niveau de la branche doit avoir proc\u00e9d\u00e9 \u00e0 la r\u00e9\u00e9valuation de son r\u00e9f\u00e9rentiel au moins six mois avant l&rsquo;expiration de l&rsquo;homologation.<\/li><li><strong>Un r\u00e9gime transitoire \u00e0 dur\u00e9e limit\u00e9e<\/strong>\u00a0: tout r\u00e9f\u00e9rentiel dont l&rsquo;homologation a expir\u00e9 avant le 27 mars 2025 est r\u00e9put\u00e9 homologu\u00e9 pour une dur\u00e9e de douze mois seulement \u00e0 compter du 28 mars 2025. Pour les r\u00e9f\u00e9rentiels dont l&rsquo;homologation expire dans les douze mois suivants, elle est prorog\u00e9e de douze mois \u00e0 la m\u00eame date.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f79cfb6 elementor-widget elementor-widget-heading\" data-id=\"f79cfb6\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"Titre2\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Pourquoi un r\u00e9f\u00e9rentiel non actualis\u00e9 expose les branches \u2014 et leurs adh\u00e9rents\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b9c0149 elementor-widget elementor-widget-text-editor\" data-id=\"b9c0149\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Un r\u00e9f\u00e9rentiel expir\u00e9, c&rsquo;est un r\u00e9f\u00e9rentiel qui n&rsquo;a plus de valeur juridique. Concr\u00e8tement, cela signifie que les employeurs adh\u00e9rents ne peuvent plus s&rsquo;appuyer sur ce document pour \u00e9valuer et d\u00e9clarer l&rsquo;exposition de leurs salari\u00e9s via la\u00a0<strong>DSN<\/strong>. La pr\u00e9somption de bonne foi dispara\u00eet, et chaque entreprise se retrouve seule face \u00e0 l&rsquo;obligation d&rsquo;appr\u00e9cier l&rsquo;exposition au regard des conditions habituelles de travail, poste par poste, salari\u00e9 par salari\u00e9.<\/p><p>Pour les\u00a0<strong>pr\u00e9venteurs<\/strong>, la situation cr\u00e9e un vide m\u00e9thodologique. Sans r\u00e9f\u00e9rentiel homologu\u00e9, l&rsquo;\u00e9valuation repose int\u00e9gralement sur l&rsquo;analyse locale, sans outil de branche standardis\u00e9.
